I just went through a workers comp case with ex employer, you have rights that your employer, and lawyers MAY not tell you about. I don't know everything but I did learn a little through the process. The workers comp law varies by state. Tennessee has a help line called Ombudsmen it's a 800 number that you can call and they tell you your rights. Which alot of people dont know they have, most of the time that's why the cases move so fast, before you find out you have rights.

There is no question here, if you think you're being wronged by the insurance company. GET A SOLID WC ATTORNEY! Speaking as an employer, we don't have any real control over the policy. All decisions are basically up to the insurance company. They'll ask if the claim is legitimate, if it was reported by a certain time frame, if there where any witnesses, etc. But, all they're really doing is looking for a reason to disqualify the claim.
